1. DEFINITIONS AND INTERPRETATION OF TERMS

The following definitions and interpretations shall apply throughout this document. It is essential that you thoroughly understand these terms before proceeding with your participation in any interview conducted through our Service:

Interview Subject ("you," "your," "participant," "interviewee"): Any individual, acting in their personal or professional capacity, who accesses the interview link and participates in an interview conducted through our Service. This includes any person who verbally responds to questions posed by our AI Agent, regardless of the duration of participation or the nature of responses provided.

User ("Client," "researcher," "interviewer," "customer"): The organization, business entity, research institution, individual, or any other party who has entered into a subscription agreement with Resonant Systems LLC, created an account on our platform, and has subsequently invited you to participate in an interview. The User may be conducting market research, customer discovery, product feedback collection, academic research, or any other legitimate interview activity. The User is responsible for determining the content, structure, and purpose of the interview in which you participate.

AI Agent ("Agent," "virtual interviewer," "automated interviewer," "AI interviewer," "AI system"): Our proprietary artificial intelligence-powered voice technology that conducts automated interviews without direct human intervention. The Agent utilizes sophisticated natural language processing algorithms, machine learning models, and voice synthesis technology to engage in conversation, ask predetermined and follow-up questions, respond contextually to your answers, and simulate a natural interview experience. The AI Agent is not a human being but a complex software system designed to conduct interviews in a conversational manner.

Service ("Resonant," "platform," "we," "us," "our," "interview platform"): The comprehensive interview platform and all associated technologies, features, functionalities, software, applications, and services provided by Resonant Systems LLC. This includes, but is not limited to, our AI Agent technology, voice recognition systems, recording capabilities, transcription services, data analysis tools, reporting features, and any other components that collectively enable the automated interview experience.

Interview Data ("data," "response data," "recorded information"): Any and all information collected, generated, recorded, transcribed, analyzed, or otherwise processed during or in connection with your interview. This encompasses the entirety of the audio recordings capturing your voice, the verbatim transcripts of your responses, any demographic or personal information you voluntarily provide, metadata associated with the interview (such as duration and timestamps), technical data necessary for Service operation, and any derivative analyses, summaries, or insights generated from your responses.

Consent ("agreement," "acceptance," "opt-in"): Your explicit, voluntary, and informed agreement to participate in the interview and to be bound by all terms, conditions, and notices outlined in this document. Consent is provided and documented when you affirmatively click the "I agree" button presented to you before the commencement of the interview. By providing your consent, you acknowledge that you have read, fully understood, and unequivocally agree to all provisions contained herein.

Recording ("audio recording," "voice recording"): The digital capture and storage of all audio content during your interview session, including your voice, responses, questions from the AI Agent, and any other sounds captured during the interview process.

Transcript ("transcription," "written record"): The textual representation of the complete interview, including all verbal exchanges between you and the AI Agent, generated through automated speech-to-text conversion technology.

Insights ("analysis," "AI-generated insights," "interview analysis"): Derivative analytical content generated from your interview, which may include summaries, key points, sentiment analysis, theme identification, notable quotes, and other interpretative information produced through algorithmic analysis of your interview responses.

2. INTRODUCTION AND BINDING AGREEMENT

These comprehensive Terms of Service and Privacy Notice (hereinafter referred to as "Terms," "Agreement," or "Notice") constitute a legally binding agreement governing your participation in research, customer discovery, or other types of interviews conducted through our Service. This document outlines your rights and obligations, explains our data collection and processing practices, and establishes the terms under which you may participate in interviews facilitated by our AI Agent technology.

Our Service operates exclusively within the United States of America, and all data processing activities occur within the territorial boundaries of the United States. These Terms are subject to and governed by the laws of the United States.

IMPORTANT NOTICE REGARDING CONSENT AND BINDING AGREEMENT:

By accessing the unique interview link provided to you, clicking the "I agree" button presented on the interview participation screen, and subsequently engaging in the interview process, you explicitly acknowledge, represent, and warrant that:

1. You have thoroughly read, carefully reviewed, and fully comprehend all provisions, terms, conditions, rights, obligations, and notices contained in this document;

2. You freely, voluntarily, and unequivocally consent to all terms and conditions outlined herein;

3. You are legally competent to enter into this binding agreement, and either: (a) are at least 18 years of age, or (b) have obtained necessary parental or guardian consent if you are under the age of 18;

4. You agree to be legally bound by all provisions contained in these Terms;

5. You consent to the recording of your voice and the collection and processing of all Interview Data as specified herein;

6. You understand that this document constitutes a legally enforceable agreement between you and Resonant Systems LLC.

If you do not agree with any provision contained in these Terms, or if you do not wish to have your interview recorded and processed as described herein, you must not proceed with the interview. In such case, you should close your browser window and discontinue use of the interview link immediately. Your participation in the interview is entirely voluntary, and you are under no obligation to proceed if you do not agree to these Terms.

3. COMPREHENSIVE PRIVACY NOTICE

3.1 Detailed Information Collection Practices

The following sections provide a comprehensive explanation of all categories of information collected during your participation in an interview conducted through our Service:

3.1.1 Direct Collection Through Interview Participation

We collect the following categories of information directly from you during your participation in the interview:

Audio Recordings: We capture, record, and store the complete audio content of your entire interview session, including but not limited to: your voice, all verbal responses, verbal reactions, speech patterns, tone, inflection, and any other sounds or utterances produced by you during the course of the interview. These recordings are high-fidelity digital audio files that preserve the acoustic characteristics of your speech.

Demographic Information: Any personal characteristics or demographic details that you voluntarily provide during the interview, which may include, but are not limited to: your age, gender identity, geographical location, educational background, professional experience, employment status, income range, household composition, marital status, or any other demographic attributes relevant to the interview's purpose. The specific demographic information requested will depend on the nature and objectives of the interview as determined by the User.

Contact Information: If requested and voluntarily provided by you, we may collect your email address or other contact information. This information is typically collected for follow-up purposes, to provide incentives or compensation, or to share research findings, depending on the arrangements made by the User.

Interview Responses: The substantive content of all your answers, comments, opinions, suggestions, experiences, preferences, and any other verbal responses provided during the interview. This includes all statements made by you in response to questions posed by the AI Agent, as well as any additional information, anecdotes, elaborations, or other content you voluntarily share during the course of the interview.

Personal Experiences and Opinions: Any narratives, experiences, opinions, beliefs, preferences, or perspectives you choose to share during the interview, which may include information about your habits, behaviors, needs, challenges, satisfactions, dissatisfactions, purchasing decisions, usage patterns, or other personal or professional experiences relevant to the interview topic.

3.1.2 Automatic Technical Collection

In addition to the information you directly provide, our system automatically collects the following technical data necessary for Service operation, quality assurance, and security purposes:

Technical Metadata: Comprehensive interview metadata including, but not limited to: precise start and end times, total interview duration, completion status, question sequence progression, response timing metrics, conversation flow indicators, and other operational data points that document the technical execution of the interview process.

Device Information: Technical specifications about the device you use to participate in the interview, which may include: device type (computer, tablet, smartphone), device model, operating system and version, screen resolution, audio input/output capabilities, and other hardware and software characteristics that may affect interview performance.

Network Data: Information about your connection to our Service, including: IP address (which may be used to determine general geographic location), connection type (wired, WiFi, cellular), internet service provider, network performance metrics, and similar networking details.

Browser Information: Technical details about the web browser you use to access the interview, including: browser type (Chrome, Firefox, Safari, Edge, etc.), browser version, browser settings relevant to audio processing, and browser plugins that may affect functionality.

Service Performance Metrics: Technical data related to the performance of the interview system, including: processing latency, voice recognition accuracy indicators, audio quality metrics, system response times, and other technical performance indicators.

Connection Quality Indicators: Measurements of the stability and quality of your connection during the interview, including: connection stability metrics, packet loss rates, audio quality degradation indicators, and other technical indicators that may affect interview quality.

Interaction Patterns: Data about how you interact with the AI Agent, including: response timing, interruption patterns, clarification requests, and other behavioral metrics that help us understand and improve the interview experience.

3.2 Comprehensive Information Use Policy

The following sections outline in detail all ways in which your Interview Data may be used, processed, analyzed, and applied by Resonant Systems LLC:

3.2.1 Primary Uses Related to Interview Fulfillment

Your Interview Data is primarily used for the following core purposes directly related to fulfilling the fundamental functions of our Service:

Transcript Generation: We process audio recordings of your interview to create verbatim textual transcriptions of the entire conversation between you and the AI Agent. These transcripts capture all verbal content exchanged during the interview and serve as the textual record of your responses. The transcription process utilizes advanced speech recognition technology to convert spoken language into text with high accuracy.

AI-Generated Insight Creation: We analyze your interview responses to produce various types of AI-generated insights, which may include: comprehensive summaries of key discussion points, identification of recurring themes or patterns, extraction of notable quotes or statements, sentiment analysis indicating emotional valence of responses, priority matrices based on expressed preferences, problem identification frameworks, and other analytical derivatives that distill and interpret the substantive content of your interview. These insights are generated through algorithmic analysis and may involve natural language processing, semantic analysis, and other computational linguistics techniques.

User Result Delivery: We securely transmit the collected Interview Data, including recordings, transcripts, and AI-generated insights, to the User who initiated the interview. This delivery enables the User to review, analyze, and utilize the information you provided for their legitimate business, research, or other purposes as disclosed to you prior to the interview.

Service Functionality: We utilize technical data to ensure the proper technical functioning of the interview platform, including audio processing, voice recognition, AI Agent responsiveness, and other core technical functions necessary for conducting the automated interview.

3.2.2 Secondary Uses Related to Service Improvement and Development

In addition to the primary uses outlined above, your Interview Data may be used for the following secondary purposes related to improving and developing our Service:

Service Enhancement Through Aggregated Analysis: We may analyze patterns, trends, and statistics derived from multiple interviews in an anonymized and aggregated form. This analysis helps us understand usage patterns, identify areas for improvement, optimize interview flow, enhance question effectiveness, and otherwise improve the overall quality, reliability, and effectiveness of our Service. Such analysis does not focus on your individual responses but rather on collective patterns across numerous interviews.

AI Model Training and Refinement: We may utilize anonymized data derived from interviews to train, test, calibrate, and improve the underlying AI technologies that power our Service. This may include enhancing natural language understanding capabilities, improving voice recognition accuracy, refining conversation flow logic, developing more natural-sounding voice synthesis, and otherwise advancing the technical capabilities of our AI Agent. Any such use involves data that has been stripped of personally identifying information and is processed in a secure, controlled environment.

Commercial Product Development: We may utilize anonymized and aggregated data to develop new features, capabilities, or product offerings. This may include creating new interview templates, developing specialized AI Agents for particular industries or use cases, creating new analytical tools, or otherwise expanding and enhancing our commercial offerings. Such development relies on broad patterns and insights rather than individual-level data.

Security and Performance Optimization: We analyze technical data to detect and address security vulnerabilities, identify and resolve performance issues, optimize system resources, and otherwise ensure the security, stability, and efficiency of our Service.

Quality Assurance and Monitoring: We may review system performance metrics, error rates, and other technical indicators to ensure the consistent quality and reliability of our Service across different devices, browsers, and network conditions.

3.3 Data Retention and Deletion Practices

The following outlines our comprehensive data retention policies and practices regarding Interview Data:

Standard Retention Period: Your Interview Data is retained in our systems for as long as the User who initiated the interview maintains an active account with our Service. There is no predetermined deletion date for Interview Data unless specifically requested by the User or unless the User's account is terminated.

Account-Based Deletion: If the User who initiated your interview deletes their account with our Service, all Interview Data associated with that account, including your recordings, transcripts, and derived insights, will be permanently deleted from our active systems within 14 days of account deletion.

No Separate Backups: We do not maintain separate backup copies of Interview Data beyond our primary storage systems. Once data is deleted from our active systems, it is not retrievable.

Anonymized Data Retention: Certain anonymized, aggregated statistical information derived from interviews may be retained indefinitely for historical analysis, trend evaluation, and service improvement purposes. This anonymized data cannot be linked back to individual interviews or participants and does not contain personally identifiable information.

Technical Log Retention: System logs containing technical information about service operations may be retained for up to 90 days for security monitoring, troubleshooting, and technical support purposes.

3.4 Comprehensive Data Protection Measures

We implement multiple layers of technical and organizational security measures to protect your Interview Data from unauthorized access, disclosure, alteration, or destruction:

Geographical Processing Limitation: All Interview Data is processed and stored exclusively within the territorial boundaries of the United States. We do not transfer Interview Data to other countries or jurisdictions.

Encryption Protocols: We employ industry-standard encryption technologies to protect your data both during transmission and storage:

All data transmitted between your browser and our servers is encrypted using TLS (Transport Layer Security) with strong cipher suites.

Stored Interview Data, including audio recordings and transcripts, is encrypted at rest using AES-256 encryption or equivalent industry-standard encryption algorithms.

Access Control Systems: Access to raw Interview Data is strictly controlled through:

4. THE INTERVIEW SERVICE: DETAILED FUNCTIONALITY AND OPERATION

4.1 AI Agent Interaction: Comprehensive Process Description

The following provides a detailed explanation of how the AI Agent functions and how you will interact with it during your interview experience:

AI Disclosure and Transparency: At the commencement of every interview, the AI Agent will explicitly identify itself as an artificial intelligence system. This disclosure ensures that you are fully informed that you are interacting with an automated system rather than a human interviewer. The AI will state its artificial nature clearly and unambiguously before proceeding with substantive interview questions.

Interview Duration Parameters: Interview sessions conducted through our Service typically range in duration from approximately 5 minutes for brief, focused interviews to up to 1 hour for comprehensive, in-depth research sessions. The specific duration of your interview will depend on the parameters set by the User, the nature and complexity of the interview topic, the number of questions included in the interview script, and the depth and extensiveness of your responses. You will generally be informed of the expected duration before the interview begins.

Clarification and Repetition Capabilities: The AI Agent is designed with interactive capabilities that allow you to request clarification or repetition of questions during the interview. If you do not understand a question, find it unclear, or simply wish to have it repeated, you may verbally request the AI Agent to rephrase, clarify, or repeat the question. The system will respond accordingly by restating the question, providing additional context, or otherwise addressing your request for clarification.

Conversational Flow Management: The AI Agent utilizes sophisticated conversation management algorithms to maintain natural dialogue flow. This includes appropriate timing of responses, recognition of when you have completed your answer, natural transition between topics, and contextual awareness of previous statements to maintain conversational coherence.

Adaptive Questioning: Based on your responses to primary questions, the AI Agent may adjust subsequent questions to explore relevant areas in greater depth, skip questions that have already been addressed in previous responses, or pursue new lines of inquiry based on the information you provide. This adaptive capability ensures a more natural and productive interview experience.

Limitations on Professional Advice: The AI Agent is explicitly programmed not to provide medical, legal, financial, tax, psychological, or other professional advice during the interview. The system is designed for information collection purposes only and not for dispensing guidance that would normally require professional qualification or licensure. If you seek professional advice, you should consult with qualified professionals in the relevant field.

Response Processing: When you speak, the AI Agent processes your verbal response through speech recognition technology, analyzes the content to determine the appropriate next question or response, and maintains contextual awareness of the overall interview progression.

Interview Termination: The interview will conclude either when all programmed questions have been addressed, when the maximum allocated time has been reached, or when you choose to end the session. At the conclusion, the AI Agent will typically thank you for your participation and provide closing information as configured by the User.

4.2 Comprehensive Recording and Data Collection Disclosure

The following provides detailed information regarding the recording and data collection processes that occur during your interview:

AUDIO RECORDING NOTICE: **ALL INTERVIEWS CONDUCTED THROUGH OUR SERVICE ARE RECORDED IN THEIR ENTIRETY.** From the moment the interview begins until its conclusion, all audio content, including your voice, responses, comments, and any other sounds captured during the session, is digitally recorded and stored. These recordings are high-quality audio files that capture the complete verbal content of the interview.

Transcription Process: Our system automatically generates complete textual transcripts of all interview content through advanced speech-to-text processing technology. These transcripts are verbatim records of the entire conversation, capturing all substantive content exchanged between you and the AI Agent. The transcription process begins in real-time during the interview and may be refined through post-processing for improved accuracy.

Demographic Information Collection: Any demographic information you voluntarily provide during the interview, whether in response to specific demographic questions or mentioned incidentally during your responses, is collected and associated with your interview record. This information helps contextualize your responses within relevant demographic parameters.

Technical Data Logging: Throughout the interview, our system automatically logs technical data about the interview session, including connection quality, audio levels, system performance metrics, and other technical parameters necessary for ensuring proper functioning of the Service and diagnosing any technical issues that may arise.

Analytical Processing: Following the completion of your interview, our systems may perform various types of analytical processing on your responses, including but not limited to: theme identification, sentiment analysis, key point extraction, and other forms of natural language processing designed to extract meaningful insights from your interview.

Persistent Storage: The complete Interview Data, including audio recordings, transcripts, and associated metadata, is securely stored in our systems and made available to the User who initiated the interview. This data remains stored for the duration specified in our retention policy as outlined in Section 3.3.

5. DATA ACCESS, CONTROL, AND SHARING POLICIES

5.1 Comprehensive User Access Rights

The following details the complete scope of information and data that is made available to the User who initiated your interview:

The User who invited you to participate in the interview will receive comprehensive access to the following components of your Interview Data:

Contact Information: Any email address or other contact information you voluntarily provide during the interview process. This information may be used by the User for follow-up communications, incentive distribution, or other purposes related to the interview as disclosed to you.

Demographic Profile: All demographic information you provide, whether in response to specific demographic questions or mentioned incidentally during your responses. This may include age, gender, location, occupation, household composition, or other demographic characteristics relevant to the interview's purpose.

Complete Interview Transcript: A verbatim textual record of the entire interview, including all questions asked by the AI Agent and all responses provided by you. This transcript captures the complete substantive content of the interview in text form.

AI-Generated Insights: Various analytical derivatives generated from your interview, which may include but are not limited to:

Thematic summaries identifying key topics discussed

Notable quotes extracted verbatim from your responses

Sentiment analysis indicating emotional valence of responses

Priority matrices based on preferences expressed

Problem/solution frameworks derived from your feedback

Opportunity identification based on needs expressed

Behavioral insights derived from response patterns

Comparative analysis with other interview responses (in aggregated form)

Interview Metadata: Technical and operational information about the interview session, including duration, completion status, timestamp information, and other session parameters.

Technical Performance Data: Information about the technical quality of the interview, including audio quality metrics, connection stability indicators, and other technical parameters that may affect interview quality.

5.2 Your Data Access Rights and Limitations

The following explains your rights regarding access to your Interview Data, as well as the limitations of these rights:

You have the following options regarding information about your stored data:

Indirect Access Rights: You may request information about your stored Interview Data by contacting the User who invited you to participate in the interview. The User may, at their discretion, provide you with access to your interview transcript, recordings, or other data components.

Process Inquiries: You may submit questions about how your data is processed by contacting the User who invited you to the interview. The User may relay these questions to us if they require additional information about our data processing practices.

Data Usage Concerns: If you have concerns about how your Interview Data is being used, you should address these concerns directly to the User who invited you to participate. The User is responsible for ensuring their use of your data complies with all applicable laws and regulations and with any specific terms or conditions they communicated to you.

Technical Support Access: If you experience technical difficulties during the interview process, you may contact our technical support team directly at support@useresonant.com. Technical support inquiries may address issues such as audio problems, connection difficulties, or other technical aspects of the interview experience. Please note that our technical support team cannot provide access to your Interview Data or process data deletion requests.

Important Limitations on Direct Access:

Resonant Systems LLC does not provide Interview Subjects with direct access to their Interview Data through our platform.

We do not maintain an Interview Subject portal or interface for accessing your data.

All data access requests must be directed to the User who invited you to participate in the interview.

We do not mediate or intervene in data access disputes between Interview Subjects and Users.

5.3 Data Deletion Request Process and Limitations

The following outlines the complete process for requesting deletion of your Interview Data and important limitations on this process:

Indirect Deletion Request Procedure: Requests to delete your Interview Data must be directed to the User who invited you to participate in the interview. Resonant Systems LLC does not accept or process deletion requests submitted directly by Interview Subjects.

User-Managed Deletion Process: The User who invited you to participate manages all data deletion directly through their dashboard. If the User determines your deletion request is legitimate and appropriate under applicable laws and regulations, they can delete your interview data themselves without involving Resonant Systems LLC.

No Direct Relay to Resonant: Unlike other platforms, Resonant does not require Users to relay deletion requests to us. Instead, Users have direct control to delete interview data through self-service tools in their dashboard.

Immediate Deletion: When a User deletes interview data through their dashboard, the deletion is immediate and permanent within our systems.

Important Limitations on Deletion:

We cannot delete Interview Data that has already been downloaded or exported by the User from our platform.

We have no control over copies of Interview Data that the User may have saved to their own systems or shared with third parties prior to the deletion request.

Anonymized, aggregated data derived from your interview that has been incorporated into broader analytical datasets may not be removed if it cannot be specifically identified.

There is no technical mechanism for Interview Subjects to directly initiate deletion of their data from our systems.

We do not notify Interview Subjects when their data has been deleted, as all communications occur through the User.

5.4 Comprehensive Data Sharing Policies

The following provides detailed information about how your Interview Data may be shared and the limitations on such sharing:

No Commercial Data Sales: We do not sell your personal information or Interview Data to third parties for monetary consideration. Your Interview Data is not made available for purchase by other businesses, marketers, or data brokers.

Limited User Access: Data sharing with the User who invited you to participate is limited to the specific components outlined in Section 5.1. The User receives access to this data for their legitimate business, research, or other purposes as disclosed to you prior to the interview.

User Responsibility for Secondary Sharing: Any additional sharing or disclosure of your Interview Data beyond our platform is the sole responsibility of the User who invited you to participate. This may include sharing with:

The User's internal team members or employees

The User's clients or customers (if the User is conducting research on behalf of another organization)

The User's service providers or contractors

Academic institutions or research partners (for research studies)

Regulatory bodies or legal authorities (if required by law)

No Control Over User Data Practices: We have no visibility into or control over how the User may use, share, or disclose your Interview Data after it has been provided to them through our platform. The User's handling of your data is governed by their own privacy policies and practices.

Direct User Engagement Recommended: You should discuss data usage rights, limitations, and expectations directly with the User before participating in the interview. You should request information about:

Who will have access to your interview responses

How your data will be used specifically

Whether and how your responses may be attributed

Any conditions or restrictions on the use of your data

The User's own privacy policy and data handling practices

Anonymized Aggregated Data: We may share anonymized, aggregated data derived from multiple interviews for the purposes of:

Service improvement and optimization

Research on interview effectiveness

Development of interview best practices

Industry benchmarking and analysis

Such anonymized data does not identify individual Interview Subjects and cannot be linked back to specific individuals.

Service Providers: We may share certain Interview Data with our own service providers who help us operate, maintain, and improve our platform. These service providers are bound by contractual obligations to use the data only for the specific purposes of providing services to us, and not for their own commercial purposes. Such service providers may include:

Cloud hosting and storage providers

Security and monitoring services

Analytics providers

Technical support services

Legal Compliance: We may disclose Interview Data if required to do so by law or in response to valid requests by public authorities (e.g., court orders, subpoenas, or government regulations).

6. COMPREHENSIVE RIGHTS AND RESPONSIBILITIES

6.1 Your Interview Participation Rights

During your participation in an interview conducted through our Service, you maintain the following comprehensive set of rights:

Selective Response Rights: You have the absolute right to decline to answer any specific question posed during the interview that you find objectionable, uncomfortable, inappropriate, or that you simply prefer not to answer for any reason. You may verbally indicate your preference to skip a question, and the AI Agent will proceed to the next question.

Interview Termination Rights: You have the unrestricted right to end the interview at any time, for any reason, without penalty or negative consequence. You may terminate the interview by explicitly stating your wish to end the session, by disconnecting from the interview link, or by closing your browser window.

Question Clarification Rights: You have the right to ask the AI Agent to explain, rephrase, or clarify any question that you find unclear, ambiguous, or confusing. The AI Agent is designed to respond to such requests by providing additional context or restating the question in alternative terms.

Process Information Rights: You have the right to request information about the interview process, including the expected duration, the general topic areas to be covered, or the purpose of specific questions. While the AI Agent has limited ability to address procedural questions, it will attempt to provide basic information about the interview structure when requested.

When you request deletion of your data (through the User), we can only delete the copies stored in our systems. Any copies that have been exported from our platform are beyond our control and ability to delete.
